Child pornography has been a persistent issue, historically rooted in erotic depictions involving minors. Modern technology, particularly the Internet and digital devices, has revolutionized pornography's production and distribution, making child pornography more accessible and widespread. Despite laws like POCSO, the Information Technology Act, and the Bharatiya Nyaya Sanhita, questions remain about their effectiveness in addressing the technological advancements and cross-border nature of these crimes.
Recent judicial rulings have further complicated the issue by suggesting that merely storing or watching child pornography is not an offense unless sexual intent or gratification is involved. This raises critical questions about the scope of child pornography laws and whether they should encompass all forms of engagement with such content. The paper evaluates existing laws, judicial interpretations, and enforcement measures, offering recommendations for more robust and comprehensive strategies to combat child pornography in the digital age.
